The federal appeals court has upheld a prohibition on sending national guard in Portland, Oregon, following a latest court ruling.

Judicial Panel Agrees to Reconsider Case

The federal appeals court ruled on Tuesday that it would rehear the legal dispute concerning the executive power with an larger panel of eleven justices. The judicial body also vacated a previous ruling from a smaller judicial group that had supported the administration.

Legal Saga Over Military Presence

This legal directive represents the latest turn in a protracted legal battle over whether the administration has the authority and justification to deploy state military units in Portland. Approximately two hundred troops have been in limbo since late September when the mobilization attempt was initiated in response to ongoing demonstrations.

Differing Viewpoints

The federal government has claimed that government employees at the ICE facility in the southern part of the city were under attack, while local authorities assert that local officers have control of the situation.

Contrary to descriptions of the city as a conflict zone, locals have been posting videos of scenic paths and a vibrant culinary culture, and organizing activities such as an Emergency Naked Bike Ride against the increased military presence.

Recent Legal Actions

The appeals court decision came after a federal judge in Portland enacted two legal injunctions this month – one preventing the federal control of the state troops, and another prohibiting the deployment of any military personnel in the state, after efforts to circumvent the initial injunction by mobilizing troops from California.

On the previous day, the ninth circuit panel had temporarily suspended the initial decision – permitting command of 200 Oregon national guard – but the second ruling stayed effective, preventing the actual deployment of the forces.

En Banc Review

The Tuesday decision means the issue will be heard by the full court – with all decisions under review together – by a group of 11 judges.

“This ruling demonstrates that facts are important and that the judicial system are working to ensure government responsibility. The founding document limits the president’s power, and local populations cannot be treated as a training ground for unchecked federal authority,” stated the legal representative in a official comment.

“The judicial body is sending a definite signal: the president cannot send the military into US cities unnecessarily. We will continue defending state legislation, principles, and autonomy as this legal proceeding moves forward and our legal battle continues in the courts.”
